Khi Phó Tổng thống và đa số Bộ trưởng trong nội các tuyên bố rằng Tổng thống "không thể đảm trách các quyền lực và nhiệm vụ của ḿnh", th́ Phó Tổng thống sẽ trở thành "Quyền Tổng thống", theo phần 4 của Tu chính án thứ 25, Hiến Pháp Hoa Kỳ.

Chủ tịch Hạ viện Mỹ Nancy Pelosi cho biết, Đảng Dân chủ sẽ tổ chức một sự kiện vào ngày 9/10 để thảo luận về Tu chính án thứ 25, sau khi Tổng thống Donald Trump nhiễm virus Corona Vũ Hán.

“Ngày mai, chúng ta sẽ nói về Tu chính án thứ 25. Nhưng hiện tại không nên bị sao nhăng khỏi chủ đề mà chúng ta đang [nói tới]”, bà Pelosi nói khi trả lời câu hỏi về gói hỗ trợ trong đại dịch virus Corona Vũ Hán.

Sau đó, khi được hỏi về việc liệu Tu chính án thứ 25 có nên được viện dẫn hay không, bà Pelosi đă không trả lời thẳng vào trọng tâm câu hỏi mà lại cáo buộc rằng, có sự thiếu minh bạch về sức khỏe của Tổng thống Trump, sau khi ông được chẩn đoán nhiễm virus Corona Vũ Hán và được điều trị vào cuối tuần qua tại bệnh viện Walter Reed.

Bà Pelosi nói: “Tôi sẽ không nói về điều đó hôm nay ngoại trừ việc nói với các bạn rằng, nếu các bạn muốn bàn về điều đó, chúng tôi sẽ gặp lại các bạn vào ngày mai. Nhưng các bạn đă đưa tôi quay trở lại quan điểm của bản thân. Thưa Tổng thống, lần cuối cùng ông có kết quả xét nghiệm âm tính trước khi có kết quả dương tính là khi nào? Tại sao Nhà Trắng không nói với đất nước sự thật quan trọng đó, về việc điều này đă trở thành điểm nóng của Nhà Trắng như thế nào?".

Không rơ bà Pelosi có đang sử dụng lối nói cường điệu để nêu lên quan điểm của ḿnh ​​hay không.

Tu chính án thứ 25 của Hiến pháp quy định việc kế vị tổng thống. Tuy nhiên, các thành viên Đảng Dân chủ trong nhiệm kỳ của Tổng thống Trump tại vị đă thường xuyên đề cập đến việc nên viện dẫn Phần 4 của Tu chính án này, liên quan đến các biện pháp không tự nguyện để tuyên bố Tổng thống không đủ năng lực làm việc.

Phần 4, vốn chưa bao giờ được áp dụng trong lịch sử Tu chính án thứ 25, có nội dung như sau:

“Bất cứ khi nào Phó Tổng thống và đa số các quan chức chính của các bộ phận hành pháp hoặc của cơ quan khác như Quốc hội, theo luật, có thể cung cấp, chuyển cho Chủ tịch ủy ban Thượng viện và Chủ tịch Hạ viện tuyên bố bằng văn bản của họ rằng, Tổng thống không thể thực hiện quyền hạn và nhiệm vụ của ḿnh, [th́] Phó Tổng thống sẽ ngay lập tức đảm nhận quyền hạn và nhiệm vụ của Tổng thống với tư cách là Quyền Tổng thống”.

Như vậy phần này quy định, khi Phó Tổng thống và đa số Bộ trưởng trong Nội các tuyên bố rằng, Tổng thống "không thể đảm trách các quyền hạn và nhiệm vụ của ḿnh", th́ Phó Tổng thống sẽ trở thành "Quyền Tổng thống" cho đến khi Tổng thống, sau một quy tŕnh phức tạp, được tuyên bố là đảm bảo trở lại cương vị.

Tuy nhiên, theo Hiến pháp, chỉ có Phó Tổng thống Mike Pence mới có thể kích hoạt việc loại Tổng thống Trump một cách không tự nguyện. Trong trường hợp Tổng thống muốn chống lại động thái của Phó Tổng thống, th́ sẽ cần có được sự ủng hộ của đa số Nội các trong chính quyền cũng như đa số trong Hạ viện và Thượng viện. Quốc hội cũng có thể thành lập một cơ quan được thông qua "theo luật" để phê chuẩn việc "Tổng thống không thể thực hiện quyền hạn và nhiệm vụ của ḿnh".

Ngoài ra, nội dung gốc của Hiến pháp Mỹ lại không chỉ rơ như thế nào là mất năng lực.

Trong những ngày gần đây, các thành viên Đảng Dân chủ đang liên tục bàn luận về Tu chính án thứ 25 sau khi Tổng thống Trump nhiễm virus Corona. Tuy nhiên, b́nh luận trên của bà Pelosi vào ngày 8/10 đánh dấu một sự leo thang mạnh mẽ trong luận điệu của Đảng Dân chủ.
