40 người nộp tiền tỷ cho công ty tại quận 1 để thực hiện ước mơ định cư Canada nhưng giờ không thể liên lạc với giám đốc doanh nghiệp nước ngoài này.

Tŕnh báo với Công an TP HCM, họ cho biết đă đến Công ty TNHH Universal Network Connection (UNC) ở ṭa nhà AB trên đường Lê Lai, quận 1, do ông Woo Kyung Soo (người Australia, gốc Hàn Quốc) làm Giám đốc, để kư hợp đồng tư vấn định cư diện AIPP từ năm 2019.

UNC giới thiệu đây là chương tŕnh thí điểm của Chính phủ Canada giai đoạn 2017-2021, thu hút lao động quốc tế đến 4 tỉnh có dân số già bên bờ Đại Tây Dương là New Brunswick, Newfoundland & Labrador, Nova Scotia và Prince Edward Island. Theo UNC, các yêu cầu tham gia AIPP rất đơn giản, không khó nhưng đương đơn bắt buộc có việc làm tại một trong 4 tỉnh nên công ty sẽ "lo". Khi họ được chấp nhận diện AIPP, cả gia đ́nh sẽ có thẻ thường trú Canada.

Trên website và fanpage, UNC ghi văn pḥng tại TP HCM, Hà Nội, cùng 4 nơi khác trên toàn cầu, chuyên triển khai tư vấn di trú Canada, Australia, Mỹ và châu Âu. Công ty này tự nhận đă thực hiện thành công các hồ sơ xin định cư với kinh nghiệm xử lư hàng ngh́n ca khó.Khi kư hợp đồng dịch vụ với UNC, khách hàng phải trả phí 1-2 tỷ đồng, thanh toán làm 3 đợt tuỳ tiến độ hồ sơ nhưng không quá 24 tháng. Tổng số tiền 40 người đă nộp là 29,3 tỷ đồng và 175.000 USD (chưa kể các nhóm khác). Hợp đồng ghi UNC có trách nhiệm t́m kiếm nhà tuyển dụng lao động tại Canada trong 6 tháng kể từ ngày kư. Nếu không, công ty cam kết hoàn trả phí đă thu.

Tuy nhiên, nhiều người cho rằng "UNC đưa các công việc không có thật, không phù hợp với khách hàng; che giấu t́nh trạng hồ sơ; cố t́nh chậm thanh lư hợp đồng; có dấu hiệu lừa đảo, bỏ trốn", ảnh hưởng xấu đến quá tŕnh xin định cư AIPP của họ.

Chị Lê Uyên (ngụ B́nh Phước) cho biết chồng làm công nghệ thông tin 10 năm và anh đứng tên đi Canada để bảo lănh vợ con. Trong hợp đồng kư tháng 7/2019 với mức phí 86.000 USD, UNC nhận chuẩn bị hồ sơ AIPP và t́m việc cho chồng chị. Gia đ́nh chị nộp đợt đầu 466 triệu đồng và chồng chị được giới thiệu làm thợ sơn nhưng không thấy tên, địa chỉ công ty tuyển dụng.

Chồng chị Uyên yêu cầu UNC đổi việc hoặc thanh lư hợp đồng th́ được báo "trừ 30% v́ từ chối việc làm". Thấy điều này không ghi trong hợp đồng, anh khởi kiện lên TAND quận 1 năm 2020. Toà gọi lên hoà giải nhưng phía UNC vắng mặt. Đến nay, nhà chị Uyên chưa lấy được tiền đă nộp.

C̣n chị Hoàng Lan (ngụ quận 7) kể, vợ chồng chị t́m hiểu qua Internet về các công ty tư vấn di trú ở TP HCM, sau đó đọc quảng cáo dịch vụ làm hồ sơ AIPP của UNC. "Thấy công ty có 6 văn pḥng, tự nhận nhiều kinh nghiệm, cảm thấy uy tín tôi mới đặt niềm tin", chị nói.

Cuối năm 2019, chồng chị Lan kư hợp đồng tư vấn 70.000 USD. Anh chị đóng 300 triệu đồng đợt 1, chờ 6 tháng để UNC t́m việc. Khi được báo công việc giám sát làm bánh ở tỉnh New Brunswick, chồng chị đóng tiếp 800 triệu. UNC hứa hoàn thiện thủ tục bảo lănh từ nhà tuyển dụng và sẽ thu nốt tiền đợt 3.

Đợi hết năm 2020 không thấy kết quả, đến tháng 1/2021, chị Lan được nhân viên phụ trách hồ sơ của UNC thông báo đă nghỉ việc, khuyên chị liên lạc Giám đốc Woo Kyung Soo. "Tôi t́m hiểu mới biết hồ sơ chồng ḿnh đă bị nhà tuyển dụng Canada loại từ năm 2020 mà UNC không cập nhật tin ǵ, vi phạm khoản 4.1.1 hợp đồng là họ phải cung cấp tiến độ thực hiện", chị Lan nói.

Tương tự, anh Nguyễn Khanh (ngụ quận 2) có vợ xin AIPP năm 2018. Phía UNC ra giá tư vấn 60.000 USD và anh đă nộp hai đợt 938 triệu đồng. UNC báo việc ngành thuỷ hải sản cho vợ anh nhưng không rơ nơi làm việc, chủ sử dụng lao động và mức lương. Tháng 6/2019, anh Khanh yêu cầu chấm dứt hợp đồng, UNC hứa trả tiền nhưng đến nay anh chưa nhận được.Do bức xúc, đầu tháng 1, hàng chục khách hàng kéo đến văn pḥng UNC to tiếng với giám đốc Woo. Hai bên đưa nhau lên Công an phường Bến Thành, ông Woo được cho là đă viết giấy "cam kết giải quyết mọi quyền lợi của khách, không bỏ trốn, mong có thời gian xử lư thiện chí". Sau 3 ngày, mọi người nhận tin ông này không tới công ty.

Nhóm khách chạy lên văn pḥng UNC thấy vắng lặng, nhân viên nghỉ làm. Phía toà nhà xác nhận UNC đóng cửa, không cách nào liên lạc. Số điện thoại công ty và kênh mạng xă hội không ai trực trả lời. Người trước đó xuất hiện với tư cách luật sư đại diện pháp lư UNC gửi email thông báo bàn giao hồ sơ tới khách, đề nghị tự liên hệ giám đốc.

Cuối tháng 1, ông Woo gặp một nhóm khách, hứa trả tiền rồi không xuất hiện từ đó.

Trả lời *********, Pḥng Cảnh sát điều tra tội phạm về tham nhũng, kinh tế, buôn lậu (PC03) Công an TP HCM cho biết đă thu thập chứng cứ, xác minh thông tin sự việc, song chưa thể cung cấp thông tin v́ đang điều tra.

Thông tin từ Bộ Kế hoạch và Đầu tư, Công ty TNHH Universal Network Connection có vốn đầu tư nước ngoài, thành lập năm 2017, đăng kư 2 ngành nghề kinh doanh là dịch vụ tư vấn du học và tư vấn đầu tư. Trên website, công ty này nói trực thuộc Tập đoàn Universal Network Connection cũng làm tư vấn di trú và do ông Woo Kyung Soo thành lập năm 2009 tại Hàn Quốc.

Theo luật sư Phan Huy Thái Nguyên (Công ty Luật TNHH Đông Phương Luật, Đoàn Luật sư TP HCM), về bản chất, hợp đồng dịch vụ tư vấn định cư AIPP của UNC có nội dung t́m, giới thiệu việc làm, tức là hoạt động đưa người Việt Nam đi làm việc ở nước ngoài. Để thực hiện hoạt động này, doanh nghiệp phải đăng kư ngành nghề tư vấn, giới thiệu và môi giới lao động, việc làm, có vốn pháp định và phải được Bộ Lao động - Thương binh và Xă hội cấp phép hoạt động dịch vụ đưa người lao động đi làm việc ở nước ngoài.

Trong khi đó, UNC chỉ đăng kư 2 mă ngành kinh doanh là tư vấn đầu tư và tư vấn du học. Bản thân dịch vụ tư vấn đầu tư không bao gồm sắp xếp, tư vấn giới thiệu việc làm.

Do vậy, việc UNC không có chức năng xuất khẩu lao động nhưng vẫn kư và không thực hiện đúng hợp đồng, không hoàn trả tiền cho khách hàng, đóng cửa văn pḥng, giám đốc cắt liên lạc, trốn tránh có dấu hiệu cấu thành tội Lừa đảo chiếm đoạt tài sản theo Điều 174 BLHS.

Cùng quan điểm, luật sư Nguyễn Văn Doanh (Công ty Luật TNHH Thanh và Cộng sự, Đoàn Luật sư TP HCM) phân tích, căn cứ Điều 4, Luật Người lao động đi làm việc tại nước ngoài theo hợp đồng, UNC mặc dù kư hợp đồng tư vấn quản lư hồ sơ nhưng nội dung thể hiện sự hỗ trợ khách hàng t́m kiếm việc làm tại Canada nên có cơ sở cho rằng UNC đă thực hiện hoạt động đưa người đi lao động tại nước ngoài. Ngoài ra, ư chí của khách và UNC đều hiểu rằng: dịch vụ tư vấn của UNC có kết quả là nguời lao động Việt Nam sẽ nhận việc làm tại Canada từ các nhà tuyển dụng mà UNC kết nối.

Các công ty đưa lao động đi làm việc nước ngoài phải được cấp phép nhưng trong danh sách cấp phép không có tên UNC. Các hành vi của công ty này là vi phạm pháp luật, theo luật sư Doanh. Các khách hàng muốn đ̣i lại tiền sẽ rất phức tạp, nhất là khi công ty đă đóng văn pḥng, giám đốc mất liên lạc.

This company claims to have successfully completed immigration applications with experience in handling thousands of difficult cases.When signing a service contract with UNC, customers have to pay 1-2 billion VND, 3 payments time depending on the progress of the profile but not exceeding 24 months. The total amount of 40 people paid was 29.3 billion VND and 175,000 USD (excluding other groups). Seeing this not in the contract, he filed a lawsuit with the District 1 People's Court in 2020. The court called for conciliation, but the UNC was absent. Up to now, Ms. Uyen's family has not received the paid money.

As for Ms. Hoang Lan (living in District 7), she and her husband researched through the Internet about immigration consulting companies in Ho Chi Minh City, then read the advertisement for the UNC AIPP application service. "Seeing that the company has 6 offices, confessing a lot of experience, I can only trust the prestige", she said.

At the end of 2019, Lan's husband signed a consultancy contract of 70,000 USD. They paid 300 million dong for the first phase, waiting 6 months for the UNC to find a job. When she was told that she was a baker in New Brunswick, her husband paid another 800 million. The UNC promises to complete the guarantee procedure from the employer and will fully collect the third payment.

Waiting for the end of 2020, there is no result, by January 2021, Ms. Lan was notified by the UNC filing officer that she had quit her job, and advised her to contact Director Woo Kyung Soo. "I found out that my husband's profile was rejected by Canadian employers since 2020 but the UNC did not update any news, violating clause 4.1.1 of the contract, they must provide implementation progress," Lan said. .

Similarly, Mr. Nguyen Khanh (living in district 2) has a wife applying for AIPP in 2018. The UNC side offers a consultation price of 60,000 USD and he has paid 938 million VND in two installments. The UNC reported the fisheries sector to his wife but did not know the workplace, employer and salary level. In June 2019, Mr. Khanh asked to terminate the contract, UNC promised to pay, but so far he has not received it. The person who previously appeared as a lawyer for the UNC legal representative emailed the handover of the file to the guest, suggested to contact the director himself.

At the end of January, Mr. Woo met a group of customers, promised to pay, and did not appear since.
