Ít có ai biết một điều quan trọng là, cái smart phone, chính là kẻ thù nằm trong túi họ khi họ tiến vào “vùng đất cấm” Điện Capitol.


Hầu hết, việc tự động truy cập vào hệ thống Free WIFI ở đây, đă báo cáo đầy đủ danh tính cũng như thông tin liên quan của họ, qua mă số máy, qua IP address và qua số điện thoại của họ. Đó là chưa kể những đoạn video clips mà chủ nhân hí hố khoe khoang thành tích “lai chym” trên các mạng xă hội, có chạy lên sao hỏa mới may ra thoát.

Những thành phần lóc cóc loong coong theo đóm ăn tàn, FBI Chưa Hỏi Đến Tội v́ c̣n đang bận truy nă những tên tội phạm nguy hiểm, sau này, thủng thẳng thế nào cũng tới phiên. Tội lăng tăng trong “vùng cấm địa” nhẹ th́ bị phạt vạ nhưng thế nào th́ hồ sơ cũng được ghi vào sổ đen của chính quyền địa phương, không trốn đi đâu được, nặng như tên leo lên đỉnh tháp phất cờ, th́ có khi vừa tù vừa phạt chưa biết chừng.

Theo như trang Luật Khoa Hoa Kỳ, th́ đây là những tội danh mà chính phủ có thể xử những “phần tử phiến loạn”, nhưng tui nghĩ chắc chắn sẽ có nhiều hơn cái list liệt kê dưới đây:

· 18 U.S.C. § 111 – Tấn công nhân viên công lực của Liên Bang (assaulting a federal law enforcement officer): Phạt tiền đến 5 ngàn đô, hoặc phạt tù đến 3 năm, có khi cả hai. Thế nhưng, nếu liên quan trực tiếp đến chết người th́ bị tử h́nh là cái chắc luôn.

· 18 U.S. Code § 930 – Mang vũ khí ở các cơ quan của Liên Bang (firearms in federal facilities): Phạt tiền hoặc phạt tù đến 5 năm, có khi cả hai.
· 18 USC 1361 – Phá hoại tài sản quốc gia (destruction to Government property): Phạt tiền tới 100 ngàn đô hoặc phạt tù đến 1 năm, có khi cả hai.
· 18 USC 2101 – Bạo loạn (riots): Phạt tiền hoặc phạt tù đến 5 năm, có khi cả hai.
· 18 USC 2112, 2114 – Trộm cắp tài sản quốc gia (robbery/burglary): Phạt tiền đến 5 ngàn đô hoặc phạt tù lên đến 15 năm, có khi cả hai.
18 U.S. Code § 2332b – Khủng bố (acts of terrorism transcending national boundaries): Tội này nặng lắm. Phạt tù từ 10 năm đến chung thân.
· 40 USC §5104(e)(1)(B) & §5109 – Xâm phạm Điện Capitol trái phép (Illegal entry into the US Capitol): H́nh phạt: đây là "bí mật quốc pḥng" dài 248 trang (link đính kèm).

Ai bị FBI điều tra hỏi tới, lúc đó cần phải có luật sư đứng ra đại diện, th́ lúc đó mới biết tội danh và án phạt …

Những phần tử gạo cội đă bị bắt, thường bị qui nhiều tội danh một lúc trong các tội được liệt kê ở trên. Cộng lại cũng mệt lắm luôn. Những phần tử xum xuê thấy người ta làm sao, cũng nhao nhao làm bậy, may ra chỉ bị ghép vào cái tội “Xâm phạm Điện Capitol trái phép”.

Tui nghĩ, cứ vượt qua hàng rào chắn bằng sắt, cách Điện chừng hơn 100 mét là đă bị … dính chấu rồi.

Ai leo lên mấy bậc thang đứng từ trên cao chụp h́nh th́ dính chắc.
Những đứa trẻ, khỏe nhanh chân leo lên thượng đỉnh phất cờ, hoặc vượt qua những cánh cửa tiến vào trong Điện, th́ chết chắc.

H́nh trên mạng, (nhóc luôn) v́ những người này thích khoe để nổi tiếng, đi tới đâu, chụp được tấm h́nh nào là up ngay lên tới đó.

Những người này có thể bị ghép vào một hoặc cả 2 tội sau đây:

· 40 USC §5104(e)(1)(B) & §5109 – Xâm phạm Điện Capitol trái phép (Illegal entry into the US Capitol).
· 18 U.S. Code § 2332b – Khủng bố (acts of terrorism transcending national boundaries): Tội này nặng lắm. Phạt tù từ 10 năm đến chung thân.

- Mới có Thẻ Xanh (Thường Trú Nhân), th́ bị phạt tiền và tù tội, có khi cả hai, nhưng thê thảm nhất, sẽ phải thi hành bản án trước. Thọ án xong, cơ hội bị lột Thẻ Xanh đuổi về Việt Nam là 99% chắc chắn. Hồ sơ sẽ không bao giờ được chấp thuận cho vào Mỹ dười bất kỳ h́nh thức nào.

Tự do ở Mỹ là tự do trong luật pháp. Những nơi ghi - Tài sản tư nhân, khu vực hạn chế chỉ dành cho người có thẩm quyền.. Cấm vào. Th́ tốt nhất đứng ngoài, muốn múa máy, muốn la hét, chửi rủa th́ cứ việc.. Miễn đừng làm phiền người khác, c̣n không th́ bị rất nhiều phiền phức.
