Tổng thống Donald Trump đă quyết định công bố t́nh trạng khẩn cấp quốc gia để có ngân sách xây bức tường dọc theo biên giới Mỹ-Mexico, khiến bị một liên minh gồm 16 tiểu bang của Hoa Kỳ, dẫn đầu là bang California đă đâm đơn kiện Tổng Thống Donald Trump để ngăn chặn t́nh trạng khẩn trương và dùng quyền hạn của ông.

Đơn kiện chỉ là một phần của cuộc đối đầu về hiến pháp mà Tổng Thống Donald Trump tạo ra hôm Thứ Sáu tuần trước khi ông tuyên bố sẽ chi hàng tỉ đô la hơn con số Quốc Hội đă cấp cho ông để xây tường biên giới.

Cuộc đối đầu này đặt ra các câu hỏi về quyền của quốc hội trong việc cấp ngân khoản chi tiêu cho chính phủ liên bang, giới hạn của thẩm quyền tổng thống trong t́nh trạng khẩn trương và ṭa án liên bang có muốn can dự vào cuộc tranh chấp này hay không, theo tin của New York Times.

Đơn kiện, nộp tại ṭa liên bang ở San Francisco, nói rằng tổng thống không có quyền để chuyển đổi số tiền đă cấp cho một mục đích khác để dùng vào việc xây tường, v́ theo hiến pháp Mỹ Quốc Hội kiểm soát vấn đề chi tiêu.

Bộ Trưởng Tư Pháp tiểu bang California, ông Xavier Becerra, nói rằng chính Tổng Thống Trump tự ông đă cho thấy lư lẽ ông đưa ra để ban hành t́nh trạng khẩn trương ở biên giới là không chính xác.

“Có lẽ bằng chứng hiển nhiên nhất là từ lời nói của chính tổng thống,” theo ông Becerra, nhắc đến phát biểu của ông Trump hôm 15 Tháng Hai rằng: “Tôi không cần phải làm điều này, nhưng tôi làm vậy để có kết quả nhanh hơn.”

Đơn kiện, có tên “California et al. v. Trump et al”, nói rằng các tiểu bang muốn bảo vệ cư dân, tài nguyên thiên nhiên và quyền lợi kinh tế của họ.

Theo đơn kiện, tổng thống đă đi ngược ư của quốc hội, dùng cuộc khủng hoảng giả tạo là vấn đề di dân bất hợp pháp để tuyên bố t́nh trạng khẩn trương và chuyển hướng chi tiêu các khoản tiền đă được quốc hội chấp thuận cho các mục đích khác để dùng vào việc xây tường.

Quốc Hội Mỹ cũng đang chuẩn bị có các biện pháp của riêng ḿnh để chặn Tổng Thống Trump về tuyên bố t́nh trạng khẩn trương của ông. Các biện pháp này gồm việc bỏ phiếu bác bỏ sắc lệnh của ông Trump và cũng có thể nộp đơn kiện.

Cùng với California và New York, các tiểu bang khác trong danh sách nguyên đơn là Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, Oregon và Virginia.

Tất cả các tiểu bang này, ngoại trừ Maryland, đều có thống đốc là người thuộc đảng Dân Chủ. (V.Giang)
