Có nhiều điều luật ở VN lỏng lẻo nhưng có những điều luật thật hà khắc. Sự việc dưới đây là một điển h́nh. Cùng vietbf khám phá nha.


Ngày 6/5, đại diện Viện kiểm sát nhân dân (VKS) quận Thủ Đức, TP.HCM cho biết, VKS đă đề nghị ṭa mức án tù từ 3-10 năm đối với 2 bị cáo trong vụ "cướp bánh ḿ" xảy ra trên địa bàn Thủ Đức.

Theo cáo trạng của VKS quận Thủ Đức, khoảng 12h ngày 18/10/2015, Nguyễn Hoàng Tuấn (17 tuổi, ngụ huyện Củ Chi) và Ôn Thành Tân (17 tuổi, ngụ quận 9) chở nhau trên xe máy để đến quán B.X trên địa bàn quận Thủ Đức xin việc làm.

Trên đường đi, Tân và Tuấn đói bụng nhưng cả hai không có tiền nên nảy sinh ư định ‘cướp’ bánh ḿ ăn. Cả hai đến trước một tiệm tạp hóa (thuộc địa bàn quận Thủ Đức), Tuấn ngồi sau xe kêu chủ tiệm tạp hóa bán 2 bọc chuối sấy, 1 ổ bánh ḿ ngọt, 1 bịch đậu phộng rang muối và 3 bịch me trộn đường.

Nhận được thức ăn từ tay chủ tiệm, bất ngờ Tuấn dùng tay trái giật lấy túi thức ăn, Tân tăng ga xe máy bỏ chạy. Chủ tiệm tạp hóa tri hô, người dân vây bắt được cả hai rồi chuyển cho Công an phường xử lư.

Tại cơ quan điều tra, Tuấn và Tân cùng khai nhận hành vi phạm tội của ḿnh.

Cáo trạng của VKS cho rằng, hành vi phạm tội của Tân, Tuấn là “Cướp tài sản” thuộc trường hợp dùng thủ đoạn nguy hiểm và truy tố 2 đối tượng theo Khoản 2, Điều 136 Bộ luật h́nh sự, với mức h́nh phạt mỗi đối tượng từ 3-10 năm tù.

Theo luật sư Đỗ Hải B́nh (Trưởng Văn pḥng luật sư Quốc Anh, Đoàn luật sư TP.HCM): "Căn cứ vào khoản 4 điều 8 BLHS th́ mặc dù đủ yếu tố cấu thành tội phạm nhưng tính nguy hiểm cho xă hội không có th́ có thể xử lư cảnh cáo hay giáo dục phạt hành chính. Không nên truy tố h́nh sự, tạm giam các bị cáo như thế, sẽ phản tác dụng”.

"Về tố tụng, hành vi là có, nhưng hậu quả là chưa xảy ra, khi xem xét vụ án, cần biết nguyên nhân và động cơ phạm tội. Ở đây cần xem đạo lư và luân lư khi hai đối tượng đói quá mà làm liều.

Thử hỏi nếu biết bị đề nghị từ 3-10 năm tù th́ hai đối tượng có dám ‘cướp’ để ăn hay không?” – Luật sư Nguyễn Văn Tài (Trưởng Văn pḥng luật sư Mai Trung Tín, Đoàn Luật sư TP.HCM).

Chiều cùng ngày, TAND quận Thủ Đức cho biết, vụ án sẽ được ṭa này đưa ra xét xử công khai vào ngày 17/5 sắp tới.
