Cho rằng sau khi mổ đục thủy tinh thể, mắt bị loét giác mạc, một Việt kiều đă kiện Bệnh viện Mắt Sài G̣n

Sáng 25-3, TAND TP HCM mở phiên ṭa xét xử sơ thẩm vụ kiệnkiện Bệnh viện Mắt TP HCM bồi thường thiệt hại ngoài hợp đồng. Nguyên đơn là ông Huynh Tom Vu (tên khác là Huỳnh Hữu Thông, SN 1960, Việt kiều Mỹ) đ̣i Bệnh viện (BV) Mắt Sài G̣n (quận 1, TP HCM) đền gần 80.000 USD.

Loét giác mạc sau mổ

Theo đơn khởi kiện, tháng 6-2009, ông Thông về Việt Nam thăm gia đ́nh kết hợp với việc chữa trị mắt. Qua giới thiệu của nhiều người, ông Thông đến BV Mắt Sài G̣n khám và được chẩn đoán mắt phải bị đục thủy tinh thể, phải mổ theo phương pháp phaco + IOL. Ngày 5-6-2009, ông Thông được thực hiện phẫu thuật với chi phí 7,9 triệu đồng và xuất viện ngay trong ngày.

Sau đó, do thấy có biểu hiện bất thường ở mắt, ông Thông đă đến tái khám vào ngày 12-6-2009. Bác sĩ tại BV Mắt Sài G̣n và BV Mắt TP HCM đều chẩn đoán mắt phải của ông bị loét giác mạc, nếu không điều trị kịp thời dễ dẫn đến nguy cơ mù vĩnh viễn. Lo sợ, ông Thông đă về Mỹ điều trị tại BV San Francisco General với chi phí 50.000 USD.

Ông Thông yêu cầu BV Mắt Sài G̣n có trách nhiệm bồi thường 85.000 USD thiệt hại về thu nhập (hiện thị lực mắt phải của ông chỉ c̣n 40%, không thể tiếp tục làm nghề lái taxi), chi phí cho người nuôi bệnh và các chi phí khác trong thời gian 10 tháng điều trị…

BV đă làm đúng (?)

Tại phiên ṭa, ông Thông chỉ yêu cầu BV Mắt Sài G̣n bồi thường gần 80.000 USD, bao gồm viện phí và tiền mất thu nhập do giảm thị lực.
Đại diện BV Mắt Sài G̣n cho biết: “Ngày 5-6-2009, BV Mắt Sài G̣n không điều trị cho bệnh nhân nào tên là Huynh Tom Vu, chỉ có bệnh nhân Huỳnh Hữu Thông, nghề nghiệp lao động tự do”. Đại diện BV Mắt Sài G̣n không đồng ư với yêu cầu đ̣i bồi thường của ông Thông, bởi lẽ “BV, các bác sĩ và nhân viên đă thực hiện đúng pháp luật về khám, chẩn đoán, phẫu thuật và theo dơi sau phẫu thuật”.

Ngoài ra, phía BV Mắt Sài G̣n c̣n cho rằng ông Thông chưa tuân thủ điều trị theo hướng dẫn của bác sĩ, tự ư không trở lại tái khám. Đại diện BV cũng không đồng ư với bản kết luận giám định pháp y của Phân viện Pháp y quốc gia tại TP HCM nhưng cũng không yêu cầu giám định lại.

Phản bác, ông Thông cho rằng ông đă đến tái khám vào ngày 8-6, 12-6 và 20-6-2009. Trong lần tái khám thứ nh́, ông đă nêu rơ t́nh trạng mắt phải của ḿnh nhưng bác sĩ chỉ cho thuốc uống và nhỏ. Đặc biệt, vào ngày 20-6-2009, trước khi đến BV, ông đă điện thoại thông báo cho bác sĩ theo dơi nhưng một bác sĩ khác đă tái khám cho ông rất sơ sài. Ông thắc mắc th́ được trả lời bác sĩ theo dơi “đi có việc”. Toa thuốc hôm đó không ghi ngày quay lại tái khám trong lời dặn như những toa thuốc trước. Do visa hết hạn, ông phải trở lại Mỹ.

TAND TP HCM dự kiến sẽ tuyên án vào sáng 1-4.

Bệnh viện mắt VN tuyên bố rằng đây là trường hợp mỗ thành công nhất, bệnh nhân chỉ có mất 80% thị lực thôi là nhất VN rồi. Ngoài ra 99% các ca mỗ mắt khác th́ các y sĩ vườn "đăm bảo" là y như rằng sau khi tháo băng ra là bệnh nhân thấy đường mới là chuyện lạ. Ai biễu ngu về VN mỗ xẽ làm chi, chưa mù là may lắm rồi, thưa kiện ǵ lũ bất lương đó cha nội.
