(Politico) – Hạ viện Hoa Kỳ đang mở ra khả năng có thể luận tội Tổng thống Donald Trump thêm lần nữa, theo các luật sư Uỷ ban Tư pháp Hạ viện.

Luật sư Hạ viện Douglas Letter cho biết trong hồ sơ đệ lên toà liên bang vào hôm thứ Hai, một cuộc luận tội lần thứ hai có thể cần thiết nếu Hạ viện phát giác ra chứng cớ mới về việc Tổng thống cố t́nh cản trở các cuộc điều tra hành vi của ông.

Luật sư Letter đưa ra lập luận trên trong phạm vi cuộc điều tra của Toà Phúc thẩm liên bang nhằm xác định liệu Dân chủ có vẫn cần đến lời khai từ cựu cố vấn pháp lư Toà Bạch Ốc Don McGahn sau khi Hạ viện bỏ phiếu luận tội đương kim Tổng thống Mỹ hai điều khoản: lạm quyền và cản trở Quốc hội hay không.

“Nếu lời khai của McGahn tạo ra chứng cớ mới hậu thuẫn kết luận Tổng thống Trump phạm tội bị luận tội mà không nằm trong những điều khoản đă được Hạ viện bỏ phiếu phê chuẩn, th́ Uỷ ban theo đó sẽ tiến hành, nếu cần thiết, cân nhắc liệu có đề nghị điều khoản luận tội mới hay không?” Letter ghi.

Đây là hồ sơ đầu tiên liên quan đến luận tội do Hạ viện đệ lên toà kể từ khi các nhà lập pháp bỏ phiếu luận tội ông Trump, theo lằn ranh đảng phái, về những cáo buộc từ nỗ lực gây áp lực buộc Ukraine điều tra đối thủ Dân chủ. Hồ sơ được đệ lên toà chỉ vài giờ sau khi Bộ Tư pháp tranh căi, bỏ phiếu luận tội làm suy yếu hồ sơ khiếu nại của các nhà lập pháp đ̣i McGahn – nhân chứng quan trọng trong cuộc điều tra của công tố viên đặc biệt Robert Mueller – ra khai.

Trong văn bản đệ lên toà vào đầu giờ thứ Hai, các luật sư Bộ Tư pháp thừa nhận, việc Hạ viện bỏ phiếu thông qua hai điều khoản luận tội tập trung vào nỗ lực rút lại viện trợ quân sự cho Ukraine và ngăn chặn cuộc điều tra của Hạ viện không đưa ra được tranh chấp về cuộc chiến pháp lư lấy lời khai của McGahn. Tuy nhiên, Bộ Tư pháp lại cho rằng, quyết định của Uỷ ban Tư pháp Hạ viện đưa ra điều khoản luận tội đồng nghĩa với việc không c̣n tính khẩn cấp trong việc giải quyết hồ sơ của Hạ viện. Như vậy, củng cố lập luận của Bộ Tư pháp: Các quan toà đơn giản rút khỏi cuộc chiến pháp lư.

Văn bản thứ hai từ bộ Tư pháp, liên quan đến việc Uỷ ban Tư pháp Hạ viện yêu cầu chứng cớ đại bồi thẩm đoàn của Mueller, cho thấy không có cơ sở trong quyết định thúc đẩy các điều khoản luận tội Tổng thống đă loại bỏ một cách hiệu quả nỗ lực luận tội tổng thống dựa trên chứng cớ từ Mueller, v́ vậy đưa ra vấn đề tranh chấp.

Hiện chưa rơ lư do tại sao Bộ Tư pháp lại cho rằng, Uỷ ban đă thừa nhận cuộc điều tra luận tội dựa vào kết quả điều tra của Mueller đă kết thúc, trong khi các luật sư Hạ viện và các nhà lập pháp lại khẳng định, cuộc điều tra vẫn đang diễn ra.

Hồ sơ mới được luật sư Letter đệ lên toà nhấn mạnh sự thật, không có ǵ có thể ngăn cản được Hạ viện luận tội ông Trump thêm một lần nữa nếu có chứng cớ mới, mặc dù không có lănh đạo Dân chủ nào ưa chuộng hướng này, nhất là khi phiên xét xử luận tội tại Thượng viện trước mắt và bầu cử sơ bộ sắp diễn ra.

Ông Letter cũng lưu ư, lời khai của McGahn có thể trở thành chứng cớ quan trọng trong phiên toà ở Thượng viện. Luật sư cho biết thêm, lời khai của McGahn quan trọng ngoài những vấn đề trên v́ Hạ viện đang cân nhắc một dự luật nổi lên từ những hành vi của ông Trump.

Các hồ sơ được đệ lên toà vào hôm thứ Hai trước t́nh trạng cuộc chiến giữa Dân chủ và Lănh tụ Đa số Thượng viện Mitch McConnell về việc mời nhân chứng ra khai trong phiên xét xử luận tội ở Thượng viện. Những nhân chứng này chưa từng ra điều trần trước bất cứ uỷ ban Hạ viện nào, đặc biệt là Tạm quyền Đổng lư Toà Bạch Ốc Mick Mulvaney và cựu cố vấn an ninh quốc gia John Bolton.

Bộ Tư pháp tranh căi trong hồ sơ của ḿnh rằng, phiên xét luận tội sắp tới là một lư do khác mà toà án nên đứng tránh sang một bên.

Bạn là người biết phục thiện, biết cái sai của ḿnh.
Việc post c̣m và h́nh bạn phải upload h́nh ảnh attach vào forum.
