Trong các lá thư mới đây, Trump vẫn tự xưng là Tổng Thống, như hình trên là trong văn thư ngày 8/2/2021. Nhóm luật sư của Trump nói rằng luận tội một cựu Tổng Thống là sai với Hiến Pháp. Tuy nhiên, trong các lá thư do Trump gửu đi, Trump vẫn tự xưng là đương nhiệm Tổng Thống.

Trump vẫn chưa hề nói là Trump thất cử, và chưa hề công nhận Joe Biden đã thắng cử.

Trump vẫn tự nhận là Trump đã thắng cử trong kỳ tuyển cử 2020 và liên tục tố cáo rằng Trump bị "trộm cuộc bầu cử" bằng nhiều cách "gian lận" mà không đưa ra chứng cớ gì.
